Prosecutors Take P2P Dev To The Supreme Court

Earlier this month a court acquitted the creator of the Winny file-sharing software, overturning an earlier decision. Prosecutors will now take the case to the Supreme Court

Isamu Kaneko, a former tutor at the University of Tokyo, was arrested in 2004 after being accused of helping users distribute copyrighted material on the Internet.

Kaneko is the creator of the anonymous P2P software, Winny, and prosecutors tried to hold him responsible for the infringements of others who used it, saying that he was aware that his program would be put to illicit uses.

In 2006, the Kyoto District Court found Kaneko guilty, and handed out a fine equivalent to around $17,000.

Earlier this month, however, the Osaka High Court acquitted the 39 year old, overturning the earlier verdict.

“Today’s ruling helps not only myself but also other computer engineers in pursuing the development of computer technology,” said Kaneko.

But the celebrations were to be short-lived.

Dissatisfied with the decision, prosecutors have announced that they have appealed to the Supreme Court .

“It’s regrettable,” said Kaneko, commenting on the news, “but I will secure a not guilty verdict again at the top court.”

    If only the original Edonkey team @ others (too many to list)would have stood up. The Edonkey200 creators just simply threw in the towel (gave up) along with $110 million dollars. It didn’t really matter though as only 10% of the network users used the official client anyway. The creators actually had $338 million & paid up $110 million so they retired w/ 228 million. Life went on as usual for this network as others too which have been shut down. When Frontcode pulled the plug on WinMx, the users set up more servers to keep the program as did ed2k when servers get taken offline, more are put up. The idea though is that because the programs haven built to withstand alot, they still stand decentralized to a degree or with help. The cartels simply have to shut down the internet to stop piracy but even that still wouldn’t help. (ad hock network, etc). Even though its a probably virus/sue happy network still, heck Kazaa still isn’t shut down. That was many years ago when the Kartel shut em down but the network still runs due to decentralization. Basically the entertainment parasites have tried to shut down almost every new piece of technology to hit the market. They are greedy bastards who need to be stopped.
